By accessing our website, submitting a form, starting a trial, or using our services as offered, you agree to these Terms. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization.

If you do not agree, do not use our site or services.

Assistencia Labs offers KineticFlow, an AI-native platform for physiotherapy and rehabilitation practices, including KineticFlow Care for clinicians and KineticFlow Client for patients. Features may include AI-assisted documentation and treatment planning, voice capture, video-based exercise engagement, scheduling, billing, and analytics—specific capabilities and availability vary by plan and configuration. Other AI-enabled products or capabilities may be offered from time to time as described on our website or in separate terms.

We may modify, suspend, or discontinue parts of any service with reasonable notice where practicable. We are not a medical provider; our products are software tools. Clinical decisions remain the responsibility of licensed professionals and their organizations.

You must provide accurate registration information and safeguard credentials. You are responsible for activity under your account. Notify us promptly of unauthorized use.

We may suspend or terminate access for breach of these Terms, risk to security, or non-payment where applicable.

As between you and Assistencia, you retain rights to data you or your end users submit to KineticFlow. You grant us a limited license to host, process, and display that data solely to provide and improve the services, as further described in our customer agreement or data processing terms.

You represent that you have obtained any necessary consents and authority to collect and process patient or staff data in the platform, and that your use complies with applicable laws (including health privacy laws where they apply).

You agree not to misuse the services: no unlawful, infringing, or harmful activity; no attempt to breach security or probe vulnerabilities without authorization; no scraping or automated access that overloads our systems; no transmission of malware; no impersonation; no use that violates third-party rights.

We may investigate violations and cooperate with law enforcement as appropriate.

Paid plans, billing cycles, and pricing are described on our website or in your order. Fees are stated in INR unless otherwise agreed. Taxes may apply in addition.

Trials and promotional offers are subject to the terms stated at signup. Unless you cancel before the trial ends, your subscription may convert to a paid plan as disclosed.

Payments may be processed by third-party processors (e.g. Razorpay). Their terms and privacy practices also apply.

Assistencia Labs and its licensors own all rights in KineticFlow, the website, branding, documentation, and related intellectual property. Except for the limited rights to use the services under these Terms or your subscription, no rights are granted.

Feedback you provide may be used by us without restriction or compensation.

THE SERVICES AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not warrant uninterrupted or error-free operation or that defects will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASSISTENCIA LABS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.

OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THAT PERIOD OR (B) INR FIVE THOUSAND, EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER LAW.

You will defend and indemnify Assistencia Labs and its affiliates against third-party claims, damages, and costs (including reasonable attorneys’ fees) arising from your use of the services, your data, or your breach of these Terms, except to the extent caused by our gross negligence or willful misconduct.

You may stop using the services in line with your subscription terms. We may suspend or terminate access for breach, non-payment, or extended inactivity as permitted by law and your agreement.

Provisions that by nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.

These Terms are governed by the laws of India, without regard to conflict-of-law principles, subject to mandatory consumer protections in your jurisdiction where they cannot be waived.

Courts located in India will have exclusive jurisdiction over disputes arising from these Terms or the marketing website, unless applicable law requires otherwise.

We may update these Terms by posting a revised version on this site. Material changes may be communicated by email or in-product notice where we have your contact details. Continued use after the effective date constitutes acceptance of the updated Terms.
